1. Nature of the service

NFsynq is a cloud-based software platform (SaaS) for operational support, document automation and immutable traceability logs (audit trail) for Food Business Operators (FBOs), consultants and laboratories. NFsynq is not an accredited certification body, nor a notified inspection agency, nor a law firm. Regulatory data and update feeds (e.g. EUR-Lex, RASFF, Codex Alimentarius) and automated risk indicators are provided purely for informational and technological purposes.

2. Exclusion of warranty on regulatory compliance

Despite rigorous data-engineering standards, cryptography and immutable logs, the Company provides no warranty, express or implied, on the absolute accuracy, real-time updating, completeness or specific legal suitability of the regulations displayed with respect to individual activities, target markets or the interpretations of local authorities. The Customer acknowledges that food compliance is subject to varying territorial jurisprudential and administrative guidelines.

3. Exclusive responsibility of the operator (FBO)

The legal, civil, administrative and criminal responsibility for the safety of products placed on the market, for the validity of HACCP self-control plans, for vulnerability and fraud assessments (VACCP/TACCP), for labelling and for compliance with mandatory or voluntary standards (IFS, BRC, ISO, GlobalGAP) lies exclusively and entirely with the Food Business Operator and the professionals it appoints. Use of NFsynq does not replace human professional judgment or validation by accredited laboratories.

4. Limitation of liability and indemnity

To the maximum extent permitted by law, the Company cannot be held liable for direct, indirect, punitive, incidental or consequential damages, administrative fines, seizures, withdrawals or recalls of lots, loss of profit, business interruption or data losses arising from the use or inability to use the platform. The Customer agrees to indemnify and hold harmless the Company, its founders, employees and partners from any claim by third parties or authorities.

5. Data processing (GDPR) and DPA

NFsynq processes personal data in compliance with EU Reg. 2016/679 (lawfulness, minimisation, advanced security); users retain the rights under articles 15-22. For the purposes of art. 28 GDPR, the Customer acts as Data Controller and the Company as Processor: it processes data only on documented instruction, adopts adequate technical and organisational measures (including encryption) and cooperates in managing data breaches. Data residency by region (EU, USA and others).

6. Digital Services Act (DSA) and identity verification (KYBC)

For the purposes of EU Reg. 2022/2065 (Digital Services Act), for document-sharing and collaborative-hub functions, the platform adopts: (i) a transparent system for reporting and rapid removal of illegal content (notice and action); (ii) procedures to verify the identity of commercial users and affiliated professionals (Know Your Business Customer) to prevent fraud.

7. Service levels (SLA)

Availability (uptime) of 99.9% on an annual basis, except for scheduled or extraordinary security maintenance. The Company is not responsible for malfunctions due to interruptions of global internet connectivity, failures of the third-party cloud provider or incompatible devices. Total compensatory liability cannot exceed the amount of the fee paid by the Customer in the twelve (12) months preceding the event.
